Terms and conditions

The present terms and conditions (hereinafter: « T&Cs ») govern the contractual relationship between you, as a user of our tools (hereinafter: the « Tools »), which include:

  • –  our website http://www.revosecure.ch (hereinafter: the « Site »), and
  • –  our application (hereinafter: the « Application »),and Revosecure Sàrl (hereafter: “Revosecure”, « we » or « us »), owner of the aforementioned Tools.Any use of our Site and/or Application is subject to your prior and unconditional acceptance of the present Terms and Conditions. If you do not accept these T&Cs, do not access or use our Tools.We reserve the right to update these Terms and Conditions at any time and therefore invite you to consult them regularly. Modifications to the T&Cs will be communicated to you by one or more of the following means: e-mail, publication on the Site and/or the Application or in any other manner we deem appropriate.Article 1 Who are we?We, Revosecure Sàrl, are a limited liability company under Swiss law, registered in the Commercial Register of the Canton of Geneva under the number CHE-458.970.372, with registered office at Rue Joseph-Girard 24, 1227 Carouge, Switzerland and VAT number: CHE-458970372.You will find our legal notices on our Site.Article 2 Access and use of our ToolsOur Revosecure Application is a free mobile application that allows you to pay by facial identification. The operation of our facial recognition technology and the description of the services we offer are described on our Site. You can find more information on your Site.2.1. Conditions of access to our ApplicationTo use our Application, you must be at least 18 years of age, be legally capable of entering into a contract and comply with the present T&Cs.The equipment (computers, software, etc.) and related costs for accessing our Tools are at your expense.2.2 RegistrationTo register on our Application and obtain an account, you must fill in all the mandatory fields in the registration form (surname, first name, photograph, address, e-mail and password). You will then receive an e-mail in order to validate the creation of the account. By creating an account, you agree to provide accurate, truthful and current personal information about yourself. It is not possible to access your account from our Site.To proceed with a payment, you must add your bank details in your account. By adding these details, you agree to provide personal, accurate, truthful and current information.Your e-mail and password are strictly personal. It is your responsibility to keep your password confidential and to limit all access to it and your equipment (computers, software, etc.).2.3 Managing your accountIn order to get credit on the Application, you must designate and provide information on your preferred method of payment (e.g. credit card on the STRIPE platform, or any other payment method made available by us) (the « Payment Method »). When you provide your payment information, we do not have access to your information but you authorize the third-party payment processor to receive, store and encrypt it. You may change your payment method or update your information on the Application. The third-party payment processor may charge you commissions on the amounts you pay, but we have no control over this. For more information, please refer to the applicable terms and conditions and privacy policy of the payment method in question.

If any information of your profile (first and last name, address, e-mail, bank details and/or password, etc.) is changed, you must update it yourself in the « my account » section directly on the Application. However, your picture can only be amended by sending us an email to contact@revosecure.ch.

In the event of incorrect information, we will not be able to provide our services correctly.

2.3 Deleting your account

You can request the deletion of your account at any time by using the contact form available in the Application menu, under the « About/Contact » tab.

We reserve the right to close or suspend your account at any time, without notice, including, but not exclusively, if you fail to comply with the present T&Cs or act in a disrespectful manner and/or against the applicable law. We will not pay any sum or compensation of any kind and for any reason, but we will reimburse the balance on your account in your favour, provided we have no counterclaim against you.

Article 3 Our responsibility

We provide our Tools with the utmost care, reliability and availability. Unfortunately, we cannot guarantee that they are accessible without interruption or that connection to the servers and/or our Tools is always possible. In the event of maintenance or interruption of one of our Tools, you will not be entitled to compensation of any kind for the duration of the maintenance or interruption.

We accept no liability for any direct or indirect loss or damage, regardless of cause, origin, nature or consequence, arising out of access or inability to access or use of one or more of our Tools (including, without limitation, any loss or damage caused by viruses affecting your computer equipment) and/or reliance on any information obtained directly or indirectly from any of our Tools.

We do not guarantee in any way the accuracy or completeness of the content made available on our Tools and we disclaim any liability in connection therewith.

Our liability in connection with the performance of our contractual obligations, whether in contract, tort or otherwise, shall be limited to the maximum extent possible. In particular, we do not assume any liability for damages suffered by you or third parties as a result of the behaviour of other users/third parties, total or partial hacking of our Tools and the resulting damage to you or any third party.

We are in no way responsible for the operation of the software and the transmission of data or information on our Tools, nor in the event of technical impossibility of connection, whatever the cause, whether or not dependent on our will.

Any content downloaded and/or obtained in any way through the use of any of our Tools is done at your own risk and we cannot be held responsible for any loss of data or damage you may suffer as a result.

We do not guarantee that the servers used and our Tools are virus-free. Therefore, we cannot be held responsible in case of virus contamination of your computer equipment, as it is your responsibility to ensure that your equipment is sufficiently protected.

We accept no liability not only for any errors or omissions in the content of the information, data or any other item on our Tools, but also for the consequences of their use.

We disclaim any liability for the purchase you make by paying with the Application.

We disclaim all liability in connection with the means of payment you have chosen, including (but not limited to) the execution of the payment.

All other warranties, express or implied, on our part are excluded.

Article 4 Your responsibility

The use of one or more of our Tools is made under your sole and entire responsibility. Consequently, you are liable to us for any damage of any nature that you cause during their use. You are responsible for your own technical equipment as well as for the protection of the software or hardware on your equipment.

You agree never to use any tool, software or process to impair, or attempt to impair, the proper functioning of our Tools. You are also prohibited from performing any action on them that is likely to place an unreasonable or disproportionate load on their infrastructure.

The use of information or any type of content available on our Tools is entirely under your responsibility.

Article 5 Intellectual property

The entire content of our Tools is protected by Swiss law, in particular the Federal Law on the Protection of Trademarks (TmPA), the Federal Law on Copyright (CopA) and the Federal Law against Unfair Competition. We draw your attention to the fact that any form of reproduction, modification, transmission or publication of all or part of each of our Tools (in particular general aspect, functionalities, texts, illustrations or graphics), for any purpose whatsoever, is prohibited without our prior written consent. Any request should be addressed to info@revosecure.ch. In the event of unauthorised use, criminal prosecution and/or civil proceedings may be instituted and payment of damages may be claimed.

Article 6 Data protection

In order for you to use our Tools, we must treat your data in accordance with the privacy policy available on our Site. We invite you to consult it for further information.

Article 7 Links to other websites

We have no influence whatsoever on the information accessible via external links to other websites and therefore accept no liability in this respect.

Article 8 Modification

We reserve the right to modify, adjust or correct one or more of our Tools at any time without notice. Additional services may also be added and offered to users.

Article 9 Miscellaneous

If any provision of the present T&Cs is invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one.

The application of any general terms and conditions from third parties is expressly excluded.

We reserve the right to assign all or part of the rights and obligations arising from these T&Cs to a third party or to have them performed by a third party.

In the event of any discrepancy between the different language versions of these T&Cs, the English version shall prevail.

Article 10 Applicable law and place of jurisdiction

The present T&Cs are subject to Swiss law, to the exclusion of its rules of private international law.

Any dispute arising out of or in connection with these T&Cs shall be submitted exclusively to the jurisdiction of the Courts of Lausanne (Switzerland). Appeal to the Federal Court is reserved.
